Proposed North Dakota Rules of Court and Amendments to the Rules of Civil Procedure, and North Dakota Supreme Court Administrative Rules, Relating to Alternative Dispute Resolution

The Supreme Court proposed adoption of Rule 8.8 and Informational Statement, and 8.9, North Dakota Rules of Court, relating to Alternative Dispute Resolution. In conjunction with proposed N.D.R.Ct. 8.8 and 8.9, the Court considered amendments to Rule 12, North Dakota Rules of Civil Procedure, and Rule 28, North Dakota Supreme Court Administrative Rules. Notice was provided under Section 7, N.D.R.Proc.R., and a hearing was held on the proposed rules and amendments on September 6, 2000, at 10:45 a.m. At that time, any written comments received were also submitted to the Court.

Subsequently, on September 13, 2000, the State Bar Association of North Dakota petitioned the Court for the adoption of a North Dakota Supreme Court Administrative Rule regarding a Joint Committee on Alternative Dispute Resolution. The Court considered the matter, and

ORDERED, Rule 8.8 and Informational Statement, and Rule 8.9, North Dakota Rules of Court are ADOPTED, as amended, effective March 1, 2001.

FURTHER ORDERED, proposed amendments to Rule 12, North Dakota Rules of Civil Procedure, as further amended, are ADOPTED, effective March 1, 2001.

FURTHER ORDERED, Rule 28, North Dakota Supreme Court Administrative Rules, is REPEALED effective March 1, 2001, as it is superceded by N.D.R.Ct. 8.9.

FURTHER ORDERED, Rule 43, North Dakota Supreme Court Administrative Rules, regarding a Joint Committee on Alternative Dispute Resolution, is ADOPTED, as amended, effective January 1, 2001.
