Amendments to the North Dakota Rules of Professional Conduct and

North Dakota Rules for Lawyer Discipline


By Order dated May 23, 2001, amendments proposed by the Joint Committee on Attorney Standards to N.D.R. Lawyer Discipl. 3.1D (4) were adopted effective August 1, 2001. Additional amendments to N.D.R. Lawyer Discipl. 3.1D (2) and (3) proposed by the State Bar Association of North Dakota were referred to the Committee for consideration. Proposed amendments to N.D.R. Prof. Conduct 1.19,N.D.R. Prof. Conduct 1.16, and the Comment to N.D.R. Prof. Conduct 1.6 were returned to the Committee for reconsideration.

Subsequently, the Supreme Court adopted amendments to N.D.R. Lawyer Discipl. 3.1D (2), (3), and (4), effective January 16, 2002. The remaining proposed amendments were held in abeyance until after the 2003 legislative session. On June 24, 2003, the Joint Committee on Attorney Standards reported to the Supreme Court that House Bill 1195 which removed the remaining reference to attorney liens on client papers from N.D.C.C. § 35-20-08 was passed and will become effective August 1, 2003.

ORDERED, proposed N.D.R. Prof. Conduct 1.19 is adopted effective August 1, 2003.

FURTHER ORDERED, proposed amendments to N.D.R. Prof. Conduct 1.16, and the Comment to N.D.R. Prof. Conduct 1.6 are adopted effective August 1, 2003.
