Amendments to the North Dakota Rules of Professional Conduct and North Dakota Rules of Lawyer Discipline

The Joint Committee on Attorney Standards filed proposed amendments to Rules 7.1, 7.2 and 1.16(e) N.D.R. Prof. Conduct; to Rule 3.1(D)(4) N.D.R. Lawyer Discipl.; and to the Comments of N.D.R. Prof. Conduct 1.6. The Committee also proposed new Rules 1.19, 7.3, 7.4 and 7.5 N.D.R. Prof. Conduct. Notice was provided under Section 7, N.D.R.Proc.R., and a hearing was held on the proposed amendments on March 26, 2001, at 10:45 a.m. At that time, any written comments received were also submitted to the Court. The Court considered the matter,

ORDERED, the amendments to N.D.R. Lawyer Discipl. 3.1(D)(4), as proposed by the Committee, are adopted and amendments to the Comment for N.D.R. Prof. Conduct 1.6, as further amended by the Court, are ADOPTED, effective August 1, 2001.

IT IS FURTHER ORDERED, the proposed amendments to N.D.R. Prof. Conduct 1.19, 1.16 and a portion of the Comment to N.D.R. Prof. Conduct 1.6 are referred to the Joint Committee on Attorney Standards for further review.

The proposed amendments regarding N.D.R. Prof. Conduct 7.1 through 7.5 remain under consideration.
