Code of Judicial Conduct
The Judiciary Standards Committee, reviewed the 2007 ABA Model Code of Judicial Conduct and recommended amendments to the North Dakota Code of Judicial Conduct. The proposed amendmentsare available at Supreme Court No. 20100378. Individuals without internet access may contact the Office of the Clerk of the Supreme Court to obtain a copy of the proposal. Written comments were received and a hearing on the proposals was conducted. The Court considered the matter, and
ORDERED, that the Preamble, Canon 1, and Canon 2 of the N.D. Code Jud. Conduct, ADOPTED effective January 1, 1994; Canon 3, N.D. Code Jud. Conduct, ADOPTED effective January 4, 2006; Canon 4, N.D. Code Jud. Conduct, ADOPTED effective March 1, 2004; and Terminology of the N.D. Jud. Conduct, ADOPTED effective March 27, 2006, are REPEALED effective 11:59 p.m. June 30, 2012.
IT IS FURTHER ORDERED, that as further amended by the Court, the proposed Preamble, Scope, Terminology, Canon 1, Rule 1.1, Rule 1.2, Rule 1.3, Canon 2, Rule 2.1, Rule 2.2, Rule 2.3, Rule 2.4, Rule 2.5, Rule 2.6, Rule 2.7, Rule 2.8, Rule 2.9, Rule 2.10, Rule 2.11, Rule 2.12, Rule 2.13, Rule 2.14, Rule 2.15, Rule 2.16, Canon 3, Rule 3.1, Rule 3.2, Rule 3.3, Rule 3.4, Rule 3.5, Rule 3.6, Rule 3.7, Rule 3.8, Rule 3.9, Rule 3.10, Rule 3.11, Rule 3.12, Rule 3.13, Rule 3.14, Rule 3.15, N.D. Code Jud. Conduct, the Compliance with the Code of Judicial Conduct section and all Commentary are ADOPTED, effective July 1, 2012.
IT IS FURTHER ORDERED, that as further amended by the Court, Canon 5 is AMENDED AND ADOPTED as Canon 4, Rule 4.1, Rule 4.2, Rule 4.3, Rule 4.4, Rule 4.5, Rule 4.6, N.D. Code Jud. Conduct, effective July 1, 2012.
The Supreme Court of the State of North Dakota convened this 14thday of February, 2012, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
