Proposed Amendments to North Dakota Rules of Civil Procedure, North Dakota Rules of Appellate Procedure, North Dakota Rules of Criminal Procedure, North Dakota Rules of Juvenile Procedure, and North Dakota Rules of Court

The Joint Procedure Committee (Committee) submitted a petition to approve proposed amendments to North Dakota Rules of Civil Procedure 4, 5, 8, 26, 33, 45 and 58; North Dakota Rules of Appellate Procedure 24, 32, and 40; North Dakota Rules of Criminal Procedure 3, 4, 4.1, 7, 9, 17, 32.2, and 41; North Dakota Rules of Juvenile Procedure 13; North Dakota Rules of Court 5.1. A synopsisand the proposed Amendments are available at Supreme Court No. 20120300. Individuals who do not have internet access may contact the Office of the Clerk of the Supreme Court to obtain a copy of the proposal.

ORDERED, that a hearing be held on the proposed amendments, Monday, October 15, 2012, at 2:00 p.m., in the Ralph J. Erickstad Courtroom of the Supreme Court, at the State Capitol in Bismarck, North Dakota. Time for personal appearances will be limited. Any person wishing to appear must notify Penny Miller, Clerk of the Supreme Court, at least three days prior to the scheduled hearing. Any person wishing to comment on the proposed amendments may do so in writing prior to the hearing. Written comments may be e-mailed to Penny Miller, Clerk of the Supreme Court, at supclerkofcourt@ndcourts.gov, or addressed to 600 E. Boulevard Ave., Bismarck, ND 58505-0530.

The Supreme Court of the State of North Dakota convened this 1st day of August, 2012, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, and the Honorable Carol Ronning Kapsner, directing the Clerk of the Supreme Court to enter the above order. The Honorable Mary Muehlen Maring and the Honorable Daniel J. Crothers, Justices, being unavoidably absent did not participate
