Proposed Repeal of North Dakota Supreme Court Administrative Order 17 and Amendment and Re-Adoption as North Dakota Rules of Court 8.1, with Appendix I, Forms A-G and Supplement 1-2, Regarding Family Mediation

[¶ 1] The Family Mediation Pilot Program was adopted March 1, 2008, in the South Central and Northeast Central Judicial Districts, as North Dakota Supreme Court Administrative Order 17. The Program was eventually adopted statewide effective September 1, 2010. At the request of Cathy Ferderer, Family Mediation Program Administrator, the Court is considering the permanent implementation of the family mediation program.

[¶ 2] Proposed North Dakota Rules of Court 8.1, and Appendix I, which includes Forms A, B, C, D, E, F and G, and Supplement 1 and 2, as well as proposed guidelines to establish income eligibility for fee waivers are available at http://www.ndcourts.gov/Court/Notices/Notices.htm. Individuals who do not have internet access may contact the Office of the Clerk of the Supreme Court to obtain a copy of the proposal.

[¶ 3] The proposal was published, and any comments on the proposed rule, forms, or supplements, were due before Monday, September 23, 2013. The Court considered the matter, and

[¶ 4] ORDERED, Proposed North Dakota Rules of Court 8.1, and Appendix I, which includes Forms A, B, C, D, E, F and G, and Supplement 1 and 2, are ADOPTED effective January 1, 2014.

[¶ 5] The Supreme Court of the State of North Dakota convened the 9th day of October, 2013, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, and the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
