Proposed Amendments to North Dakota Supreme Court Administrative Rules 41 to Prohibit Dissemination of Copies of Recordings of Court Proceedings and Establish the Transcript as the Official Record and Proposed Repeal of North Dakota Supreme Court Administrative Rules 40


[¶ 1] On July 10, 2015, the Digital Recording Work Group submitted a petition to amend North Dakota Supreme Court Administrative Rules 40, Access to Audiotapes of Proceedings in District Court. The Court referred the proposed amendments to the Court Services Committee. On October 1, 2015, the Court Services Committee submitted its recommendation to amend North Dakota Supreme Court Administrative Rules 41 and to repeal North Dakota Supreme Court Administrative Rules 40. The proposals would prohibit dissemination of copies of recordings of district court proceedings and establish the transcript as the official record.

[¶ 2] The proposed amendments are available at http://www.ndcourts.gov/Court/Notices/Notices.htm. Individuals who do not have internet access may contact the Office of the Clerk of the Supreme Court to obtain a copy of the proposal. The Court considered the matter, and

[¶ 3] ORDERED, any person wishing to comment on the proposed amendments may do so in writing before Friday, December 9, 2015. Written comments may be e-mailed to Penny Miller, Clerk of the Supreme Court, at supclerkofcourt@ndcourts.gov, or addressed to 600 E. Boulevard Ave., Bismarck, ND 58505-0530.

[¶ 4] The Supreme Court of the State of North Dakota convened the 6th day of November, 2015, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Carol Ronning Kapsner, the Honorable Daniel J. Crothers, Justices, and the Honorable Lisa Fair McEvers, Justices, directing the Chief Deputy Clerk of the Supreme Court to enter the above order.
