Proposed Amendments to North Dakota Supreme Court Administrative Rules 41 Regarding Access to Court Records and North Dakota Supreme Court Administrative Rules 40 Regarding Access to Audiotapes of Proceedings in District Court


[¶ 1] On April 6, 2016, a hearing was held regarding the Court Services Committee's recommendation to amend North Dakota Supreme Court Administrative Rule 41, Access to Judicial Records, and to repeal North Dakota Supreme Court Administrative Rule 40, Access to Audiotapes of Proceedings in District Court, the Digital Recording Work Group's recommendation to amend North Dakota Supreme Court Administrative Rule 40, comments to the proposals and alternative draft amendments.

[¶ 2] In consideration of the comments and hearing, the Court is requesting comments on second alternative draft amendments to North Dakota Supreme Court Administrative Rules 40 and North Dakota Supreme Court Administrative Rules 41. The proposed amendments are available at http://www.ndcourts.gov/Court/Notices/Notices.htm. Individuals who do not have internet access may contact the Office of the Clerk of the Supreme Court to obtain a copy of the proposal. The Court considered the matter, and

[¶ 3] ORDERED, any person wishing to comment on the proposed amendments may do so in writing before Wednesday, July 20, 2016. Written comments may be e-mailed to Penny Miller, Clerk of the Supreme Court, at supclerkofcourt@ndcourts.gov, or addressed to 600 E. Boulevard Ave., Bismarck, ND 58505-0530.

[¶ 4] The Supreme Court of the State of North Dakota convened the 29th day of June, 2016, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Carol Ronning Kapsner, the Honorable Daniel J. Crothers, Justices, and the Honorable Lisa Fair McEvers, Justices, directing the Chief Deputy Clerk of the Supreme Court to enter the above order.
