Proposed Amendments to North Dakota Supreme Court Administrative Rules 41 to Prohibit Dissemination of Copies of Recordings of Court Proceedings and Establish the Transcript as the Official Record and Proposed Repeal of North Dakota Supreme Court Administrative Rules 40


[¶ 1] On July 10, 2015, the Digital Recording Work Group submitted a petition to amend North Dakota Supreme Court Administrative Rules 40, Access to Audiotapes of Proceedings in District Court. The Court referred the proposed amendments to the Court Services Administration Committee. On October 1, 2015, the Court Services Administration Committee submitted its recommendation to amend North Dakota Supreme Court Administrative Rules 41 and to repeal North Dakota Supreme Court Administrative Rules 40.

[¶ 2] The Court issued a notice of comment regarding the proposed amendments. The Court reviewed the comments, as well as alternative draft amendments to North Dakota Supreme Court Administrative Rules 40, Access to Audiotapes of Proceedings in District Court.

[¶ 3] The proposed amendments of the Court Services Administration Committee and the alternative draft amendments are available at http://www.ndcourts.gov/Court/Notices/Notices.htm. Individuals who do not have internet access may contact the Office of the Clerk of the Supreme Court to obtain a copy of the proposal. The Court considered the matter, and

[¶ 4] ORDERED, that a hearing be held on the proposed amendments and alternative draft amendments to North Dakota Supreme Court Administrative Rules 40 and 41, Wednesday, April 6, 2016, at 2:45 p.m., in the Ralph J. Erickstad Courtroom of the Supreme Court, at the State Capitol in Bismarck, North Dakota. Time for personal appearances will be limited. Any person wishing to appear must notify Penny Miller, Clerk of the Supreme Court, at least three days prior to the scheduled hearing. Any person wishing to comment on the proposed amendments may do so in writing prior to the hearing. Written comments may be e-mailed to Penny Miller, Clerk of the Supreme Court, at supclerkofcourt@ndcourts.gov, or addressed to 600 E. Boulevard Ave., Bismarck, ND 58505-0530.

[¶ 5] The Supreme Court of the State of North Dakota convened the 19th day of February, 2016, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Carol Ronning Kapsner, the Honorable Daniel J. Crothers, Justices, and the Honorable Lisa Fair McEvers, Justices, directing the Chief Deputy Clerk of the Supreme Court to enter the above order.
