Proposed Amendments to North Dakota Supreme Court Administrative Rule 41 Regarding Access to Court Records and North Dakota Supreme Court Administrative Rule 40 Regarding Access to Audiotapes of Proceedings in District Court

[¶ 1] On July 10, 2015, the Digital Recording Work Group filed a petition to amend North Dakota Supreme Court Administrative Rule 40, Access to Audiotapes of Proceedings in District Court. On July 15, 2015, the Court referred the proposal to the Court Services Administration Committee. On October 1, 2015, the Court Services Administration Committee submitted its recommendation to amend North Dakota Supreme Court Administrative Rule 41 and to repeal North Dakota Supreme Court Administrative Rule 40. The Court issued a notice of comment regarding the proposed amendments from the Court Services Administration Committee.

[¶ 2] The Court reviewed the comments and alternative draft amendments to North Dakota Supreme Court Administrative Rule 40. On February 22, 2016, the Court issued a notice of hearing and comment regarding the proposed amendments of the Court Services Administration Committee and the alternative draft amendments. A hearing was held April 6, 2016.

[¶ 3] In consideration of the comments and hearing, on June 30, 2016, the Court requested comments on second alternative draft amendments to North Dakota Supreme Court Administrative Rules 40 and 41.

[¶ 4] The proposed amendments are available at http://www.ndcourts.gov/Court/Notices/Notices.htm. The Court considered the matter, and The Court considered the matter, and

[¶ 5] ORDERED, that the second alternative proposed amendments to North Dakota Supreme Court Administrative Rules 40 and 41 are ADOPTED, effective October 1, 2016.

[¶ 3] The Supreme Court of the State of North Dakota convened the 10th day of August, 2016, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Carol Ronning Kapsner, and the Honorable Lisa Fair McEvers, Justices, directing the Clerk of the Supreme Court to enter the above order. The Honorable Daniel J. Crothers, Justice, voted against the action.
