Petition to Move Chambers from Linton to Mandan Friday, May 22, 1998

Notice is hereby given that on April 13, 1998, the Honorable Benny A. Graff, Presiding Judge of the South Central Judicial District, filed a Petition for Change of Designation of Resident District Court Judgeship Chamber under Administrative Rule 7.1(2), requesting the Supreme Court to change the designation of District Court Judgeship No. 8, with chambers at Linton, North Dakota, to chambers at Mandan, North Dakota, previously occupied by Judgeship No. 3 which was abolished effective March 11, 1998. The Court considered the matter, and

ORDERED, under Administrative Rule 7.1(4), this is notice a hearing will be held by the Supreme Court in the Supreme Court courtroom at the State Capitol, in Bismarck, North Dakota, from 10:00 a.m. to 12:00 noon, May 22, 1998, at which time any person may appear and present information on the following:

1) Annual district court combined caseload for the most recent three-year period and any discernible caseload trends or patterns;

2) Number and location of attorneys;

3) Community facilities (e.g. restaurants, motels) and convenience of travel access from surrounding communities;

4) Compliance with or commitment to court facility standards (size of available space, environmental controls, quality of court facilities, law library space)

5) Proximity to detention facilities for adults and juveniles;

6) Proximity to a Human Service Center of the Department of Human Services;

7) Impact of any change of chamber on travel time for judges, court personnel, attorneys, and litigants;

8) Population distribution in the judicial district;

9) Impact on affected judicial system employees; and

10) Recommendation of the presiding judge of the judicial district after consultation with the judges of the judicial district.

Presentations will be limited to 5 minutes per individual.

Any person who wishes to appear should notify the Clerk of the Supreme Court, in writing, three days prior to the date scheduled for the hearing. Any person who cannot appear is encouraged to address written comments to Penny Miller, Clerk of the Supreme Court, 600 E Boulevard Ave Dept 180, Bismarck, North Dakota, 58505-0530, for submission to the Supreme Court prior to the consultation.

This Notice constitutes the notice required under subsections 3 and 6 of Administrative Rule 7.1(2) and will be served and published accordingly.
