ORDER AMENDING DECEMBER 2, 1998, ORDER

Amendments to the North Dakota Rules of Civil Procedure, Rules of Criminal Procedure, Rules of Appellate Procedure, and Rules of Court

By Order dated December 2, 1998, this Court adopted amendments to several procedural rules which became effective March 1, 1999. Rule 6.10, North Dakota Rules of Court, regarding courtroom oaths was among the rules that were adopted by the Court.

This Court has been requested by the North Dakota Legislative Council to clarify the Explanatory Note to N.D.R.Ct. 6.10, which identifies N.D.C.C. §44-05-02 as superseded, as that statute appears to be broader in scope and applies outside courtroom settings. The Court considered the matter, and

ORDERED, the December 2, 1998, Order of this Court is amended nunc pro tunc to delete reference to N.D.C.C. §44-05-02 in the Explanatory Note to Rule 6.10 of the North Dakota Rules of Court.
