NOTICE OF CONSULTATION

IN THE MATTER OF THE JUDICIAL VACANCY IN DISTRICT JUDGESHIP NUMBER 9 IN THE CHAMBER AT JAMESTOWN, NORTH DAKOTA, SOUTHEAST JUDICIAL DISTRICT

On January 25, 1999, under Section 27-05-02.1(1), N.D.C.C., Governor Edward T. Schafer notified this Court that the Honorable Randall L. Hoffman, District Judge for the Southeast Judicial District, will resign from his position as District Judge effective April 30, 1999, thus creating a vacancy. Section 27-05-02.1, N.D.C.C., requires the Supreme Court to determine whether the vacancy should be filled. The Supreme Court considered the matter, and

ORDERED, that the Supreme Court will consult with the judges and attorneys of the Southeast Judicial District, in the courtroom of the Supreme Court at the State Capitol in Bismarck, North Dakota, from 10:00 a.m. to noon, Wednesday, March 3, 1999. Any judge or attorney from the Southeast Judicial District wishing to appear should notify the Clerk of the Supreme Court, in writing, three days prior to the date scheduled for the consultation.

Under Administrative Rule 7.2, anyone interested in providing comments to the Supreme Court regarding this matter may do so in writing by Tuesday, March 2, 1999. Address written comments to Penny Miller, Clerk of the Supreme Court, 600 E. Boulevard Ave., Dept. 180, Bismarck, ND 58505-0530.

The Supreme Court of the State of North Dakota convened January 27, 1999, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable William A. Neumann, the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, Justices, directing the Clerk of the Supreme Court to enter the above order.
