Proposed Amendments to Rule 8.4, North Dakota Rules of Professional Conduct
On July 7, 1999, the Joint Committee on Attorney Standard filed proposed amendments to Rule 8.4, North Dakota Rules of Professional Conduct. On July 9, 1999, Notice of Comment was served under Section 7, N.D.R.Proc.R. According to the Notice of Comment and subsequent Order entered August 18, 1999, the comment period expired October 1, 1999. Between July 9, 1999, and October 1, 1999, numerous comments regarding the proposed amendments were received and referred to the Court. On October 25, 1999, the proposed amendments and comments were referred to the Joint Committee on Attorney Standards for further consideration in light of the comments. On March 30, 2000, the Joint Committee on Attorney Standards returned Rule 8.4 to the Supreme Court with one change and a lengthier report of the Committee's consideration of Rule 8.4. A copy of the proposed Amendments is attached. The Court considered the matter, and
ORDERED, that a hearing be held on the proposed amendments, Tuesday, June 6, 2000, from 9 a.m. until 10:30 a.m., in the Courtroom of the Supreme Court, at the State Capitol in Bismarck, North Dakota. Any person wishing to comment on the proposed amendments may do so in writing before June 6, 2000. Time for personal appearances will be limited; therefore, written comments are encouraged. Address written comments to Penny Miller, Clerk of the Supreme Court, 600 E. Boulevard Ave., Dept. 180, Bismarck, ND 58505-0530. Persons previously providing written comments need not do so again unless addressing a new concern.
The Supreme Court of the State of North Dakota convened April 26, 2000, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable William A. Neumann, the Honorable Dale V. Sandstrom, the Honorable Carol Ronning Kapsner, Justices, directing the Clerk of the Supreme Court to enter the above order. The Honorable Mary Muehlen Maring voted no.
