Amendments to Rule 8.5, North Dakota Rules of Court


On October 1, 1996, the Supreme Court adopted Rule 8.5, North Dakota Rules of Court, permitting the use of summary proceedings in domestic relations cases in certain judicial districts. Rule 8.5, North Dakota Rules of Court, was to remain in effect until April 1, 1998, but was amended March 26, 1998, to extend the period to October 1, 1999. Rule 8.5, subsection (h), states: "After the trial period, the Court will decide if statewide implementation of the process is feasible and warranted." The Court received reports and recommendations from the Honorable Bruce E. Bohlman, District Judge in the Northeast Central Judicial District, and the Honorable Robert W. Holte, District Judge in the Northwest Judicial District, who implemented the summary proceedings on a trial basis. The Court considered the matter, and

ORDERED, the proposed amendments to Rule 8.5, North Dakota Rules of Court, extending the trial period to October 1, 2001, to permit the Court to consider statewide implementation are ADOPTED, effective immediately.
