Amendments to the North Dakota Rules of Professional Conduct

On October 22, 1996, the Joint Attorney Standards Committee filed its Report with proposed amendments to the North Dakota Rules of Professional Conduct. The Supreme Court adopted Rule 3.9, NDRPC, on an emergency basis, effective November 1, 1996, and ordered that the remaining matters be heard on December 3, 1996. October 25, 1996, the Clerk distributed the required notice. The Court considered the matter, and

ORDERED, that Rules 1.5 (Fees), 1.18 (Governmental Entity as the Client), 5.3 (Responsibilities Regarding Nonlawyer Assistants), 5.4 (Professional Independence of a Lawyer), 5.6 (Restrictions on Right to Practice), 7.2 (Firm Names and Letterheads) and Terms, are amended, effective March 1, 1997.

IT IS FURTHER ORDERED, that Rules 1.17 (Sale of a Law Practice) and 5.7 (Responsibilities Regarding Law-Related Services)are adopted, effective March 1, 1997.

IT IS FURTHER ORDERED, that Rule 3.9 (Advocate in Nonadjudicative Proceedings), as further amended, is adopted on a final basis, effective December 11, 1996.
