Subject matter jurisdiction cannot be conferred by agreement, consent, or waiver.
Important factors in determining whether the child has a significant connection with North Dakota include the resident parent exercising parenting time in the state, the child having contact with other relatives in the state, receiving health care within the state, and spending a considerable amount of time residing in the state prior to moving.
The language of the Uniform Child Custody Jurisdiction Enforcement Act indicates that mere visitation of the child in the state is sufficient to retain exclusive, continuing jurisdiction.
Before North Dakota loses exclusive, continuous jurisdiction, a court must find that the child no longer has a significant connection with the state and there is no longer substantial evidence concerning the child's care, protection, training, and personal relationships.
