Parties' Statement of Issues
Whether the District Court’s Order’s factual basis regarding Didier’s behavior is sufficient to legally conclude Didier has serious difficulty controlling his behavior.
Whether Didier has been shown to have serious difficulty controlling his behavior that distinguishes Didier from the typical recidivist in the ordinary criminal case.
Lawrence Didier appeals from a district court order denying his petition for discharge from civil commitment.
Didier was previously convicted of two counts of sexual assault, one count of gross sexual imposition, and one count of indecent exposure occurring in 1988, 1998, and 2008. In 2010, Didier was adjudicated a sexually dangerous individual, and the district court ordered Didier’s civil commitment. In November 2019, Didier filed a petition seeking discharge from civil commitment. After a hearing was held, the district court denied his petition.
On appeal, Didier argues the order denying his discharge from civil commitment was not supported by clear and convincing evidence to conclude he remains a sexually dangerous individual.
