Summary

Respondents appeal from a judgment permitting SCS Carbon Transport LLC (“SCS Carbon”) to enter their lands to conduct surveys and examinations.

SCS Carbon commenced these lawsuits against Respondents to enter their lands to conduct certain surveys and examinations. SCS Carbon alleged it intends to construct an interstate pipeline in North Dakota and four other states which would transport carbon dioxide and deliver it to sequestration sites in North Dakota. SCS Carbon alleged it needs to access Respondents’ property to determine the appropriate pipeline route.

After Respondents answered the petitions for entry, SCS Carbon moved for summary judgment, arguing there was no genuine dispute of material fact and it was entitled as a matter of law to enter Respondents’ property to conduct surveys and examinations under N.D.C.C. § 32-15-06. Respondents opposed the motion. After oral argument, the district court granted summary judgment to SCS Carbon and entered judgment granting SCS Carbon’s petitions for entry.

On appeal, Respondents argue N.D.C.C. § 32-15-06 authorizes a “taking” in violation of the takings clause under Art. I, § 16 of the North Dakota Constitution, and the district court’s order, including its rejection of reasonable limitations upon SCS Carbon’s right of entry, authorizes a taking.
