Highlight
A new rule applies retroactively to final convictions in very limited circumstances. Substantive rules are generally applied retroactively because they carry a significant risk that a defendant stands convicted of an act the law does not make criminal or faces punishment the law cannot impose on him.
The rule announced in Birchfield, as it applies to criminal refusal to submit to a warrantless chemical blood test, is substantive and applies retroactively because the State no longer has authority to punish an individual for refusing to submit to a warrantless blood test.
