Whether the District Court erred in finding that the juveniles A.R.S. and M.B. are deprived and that such deprivation is not due primarily to the lack of financial means of the children’s parents.
Summary
A.S., the mother of A.R.S. and M.B., appeals a juvenile court order finding her children were deprived. The court ordered the children shall continue to be removed from the care, custody, and control of A.S. and the children’s father, B.B.
On April 1, 2020, the State filed a deprivation petition, alleging A.S. and B.B.’s two children were deprived under N.D.C.C. § 27-20-02(8). After a deprivation hearing, the court found the children were deprived by clear and convincing evidence. The court ordered the children shall continue to be removed from the care, custody, and control of their parents.
On appeal, A.S. argues the court erred by finding the children were deprived. Specifically, she asserts the finding of deprivation was based primarily on the parents’ financial limitations.
