Whether the district court erred in admitting a video recording of the child victim’s forensic interview wherein the child disclosed sexual abuse by Bradshaw in both McHenry County and in Ward County with the portions of the video referring to the sexual acts that occurred in Ward County muted.
Summary
Connor Bradshaw appeals from a criminal judgment entered after a jury found him guilty of gross sexual imposition.
In July 2019, Connor Bradshaw was charged with gross sexual imposition, in violation of N.D.C.C. § 12.1-20-03. Prior to trial, the State notified the court of its intention to offer A.Z.’s forensic interview. Anticipating defense counsel’s objection, the State had prepared a redacted version of the video which muted references to sexual acts by Bradshaw against A.Z. in a different county. The State sought to admit the unredacted video but if the district court found the statements about the sexual acts inadmissible, then the State sought to admit the redacted video. Bradshaw objected to the unredacted video because it referenced other bad acts not charged in the case and objected to the redacted video because he had not seen the redacted version. During trial, the redacted video of A.Z.’s forensic interview was admitted.
On appeal, Bradshaw argues the district court erred by failing to use one of the remedies under N.D.R.Crim.P. 16(d) when the redacted video was not disclosed prior to trial.
