    ISSUE 2: Should Defendant Susan Coons be granted a new trial because the trial judge made the prejudicial statement that or she lost the probate trial?

Summary

Susan Coons appeals from a criminal judgment finding her guilty of forgery or counterfeiting, in violation of N.D.C.C. § 12.1-24-01(1)(b), and of unauthorized use of personal identifying information, over $1,000, in violation of N.D.C.C. § 12.1-23-11(2).

On appeal, she argues this Court should remand to the district court because the district court unlawfully closed the courtroom without making Waller findings. She also argues the case should be remanded because the court made prejudicial statements during her trial. The State contests these arguments.
