8th Circuit decides N.D. case Monday, July 3, 2023

The United States Court of Appeals for the Eighth Circuit concluded that WPX Energy did not exhaust its tribal court remedies, and that a ruling in federal court on the question of tribal court jurisdiction was premature. The Court, therefore, vacates the injunction and remands to the district court with directions to dismiss the complaint without prejudice.
