8th Circuit decides N.D. case Tuesday, August 22, 2023

The federal appeals court said that the district court did not err in denying the request for a preliminary injunction as plaintiffs failed to show they will suffer irreparable harm absent the entry of a preliminary injunction; plaintiffs failed to show how the Final Rule will prevent them from engaging in constitutionally protected conduct and failed to show that they would suffer actual economic harm.
