8th Circuit decides N.D. case Wednesday, April 28, 2021

The United States Court of Appeals for the Eighth Circuit has affirmed the trial court's denial of a motion to withdraw a guilty plea in a North Dakota assault case. 

The court held that the district court did not err in denying defendant's motion to withdraw his guilty plea as his plea was knowing and voluntary and he not provided a fair and just reason to withdraw it; the fact that a defendant may have pleaded not guilty earlier in the proceedings is not a valid reason for withdrawing a subsequent guilty plea.
