8th Circuit decides N.D. case Friday, January 28, 2022

The United States Court of Appeals for the Eighth Circuit has issued an opinion in a North Dakota insurance coverage case. The court held that the district court did not err in determining that the malpractice policy issued to its insureds did not apply to the malpractice claims at issue because the insured knew or reasonably should have known, as of the effective date of the policy, that his conduct during the underlying litigation might be the basis for a demand for money against him.
