8th Circuit decides N.D. case Wednesday, April 13, 2022

The United States Court of Appeals for the Eighth Circuit has issued an opinion in a North Dakota case. The court held that the district court did not err in revoking defendant's supervised release based on its finding that he violated the treatment and employment conditions of his supervised release; defendant could not collaterally attack the provisions of his 2015 judgment and commitment order in this subsequent revocation proceeding; the district court did not err in imposing a condition of supervised release requiring defendant to participate in sex-offense specific treatment as the condition was clearly related to the nature and circumstances of the offense and defendant's personal characteristics.
