8th Circuit decides N.D. case Thursday, June 30, 2022

The United States Court of Appeals for the Eighth Circuit has issued an opinion in a North Dakota case.

In United States v. Delong the court declined to enforce the appeal waiver and denied the government's motion to dismiss because, at the change of plea hearing, the district court did not explain the terms of the appeal waiver or ensure that defendant understood those terms. The court held that defendant's sentence was not substantively unreasonable, as the district court did not err in deciding to place greater weight on defendant's history and characteristics, including his criminal history, than it placed on his mitigating factors.
