8th Circuit decides N.D. case Wednesday, August 3, 2022

The United States Court of Appeals for the Eighth Circuit has issued an opinion in a North Dakota case.

In Highline Exploration, Inc. v. QEP Energy Company the court held that the district court did not err in granting summary judgment to defendants on plaintiffs' claim that the contracts in place permitted defendant to deduct post-production costs from plaintiffs' royalty payments; under the "free and clear" clause of the agreements, the only costs excluded from the royalty payments are the normally excluded costs of development and operation.
