8th Circuit decides N.D. case Thursday, April 20, 2023

The United States Court of Appeals for the Eighth Circuit has issued an opinion in a North Dakota case.

In Howe v. Gilpin the court held that the affidavit defendants provided to procure an arrest warrant provided probable cause for plaintiff's arrest, even if it is corrected to include the information plaintiff alleges was recklessly omitted from the affidavit; the district court did not err in granting defendants' motion for summary judgment on plaintiff's Fourth Amendment claim.
