8th Circuit decides two N.D. cases Wednesday, June 14, 2023

The United States Court of Appeals for the Eighth Circuit has issued opinions in two North Dakota cases.

In United States v. Williamsthe courth held that he sentence imposed upon the revocation of defendant's supervised release was not substantively unreasonable; however, the supervised release portion of the sentence, when combined with the sentence imposed in a prior revocation and the term of imprisonment imposed in this revocation, exceeds the allowable sentence by five days, and the sentence is vacated; remanded to the district to amend the supervised release portion of the sentence.

In United States v. Hall the court held that the district court did not procedurally err in adopting the unobjected-to guidelines range set forth in the presentence report; the district court did not abuse its discretion in applying an upward variance based on the victims' emotional and psychological injuries.
