Insurance Healthcare Enforcement Attorney

Summary of Work

This position is responsible for providing legal advice and opinions for the Insurance Commissioner, Deputy Commissioner and other Department employees; advising agency personnel on legal matters; drafting proposed orders; and representing the Department in regulatory matters including litigation in court.

The position works with a team of attorneys and a legal assistant under the direction of the Department’s General Counsel.

Responsibilities:

1.Perform legal research concerning legal issues.

2.Work with Department staff and other law enforcement regarding the development of administrative, civil and criminal enforcement actions and insurance fraud prosecution.

3.Draft orders and agreements, and represent the Department in administrative or civil proceedings or coordinate with outside counsel.

4.Negotiate resolutions of civil and administrative proceedings.

5.Represent the Department in judicial proceedings in a competent, effective and ethical manner.

6.Keep abreast of state and national insurance issues, laws and practices.

7.Coordinate work with other North Dakota departments and federal agencies as needed.

8.Respond to inquiries from the general public, the insurance industry, and others.

9.Performs other duties as necessary and/or assigned by the Commissioner, Deputy Commissioner and General Counsel.

Minimum Qualifications

 A Juris Doctorate degree and a license to practice law in North Dakota.

  1. Two or more years of experience as an attorney practicing criminal law.
  2. High ethical standards and a positive personnel history.
  3. Excellent written and verbal communication skills.
  4. Strong interpersonal skills needed to work well with clients, colleagues, government officials, and the public.
  5. Good judgment, strong reliability, and a willingness to devote time and energy necessary to provide excellent legal services to the Insurance Commissioner.
  6. Excellent time management and organization skills.
  7. Successful completion of the interview process, reference checks, and criminal record checks.

Preferred Qualifications

Preference will be given to applicants with:

  • Insurance background
  • ACA Knowledge
  • HIPAA Knowledge
  • Prosecution Experience
  • ERISA Knowledge
